The US Congress is unlikely to pass any AI safety legislation before the November midterm elections. Legislative proposals, including the Frontier Act and the AI Kill Switch Act, remain stalled in the procedural process.

Key negotiators, including Senators John Thune, Amy Klobuchar, and Ted Cruz, have failed to advance these bills. Consequently, any significant regulatory action is postponed until after the upcoming elections.

Market uncertainty regarding these regulations has impacted AI-related stocks. The Philadelphia Stock Exchange Semiconductor Index, known as the SOX, recently dropped nearly 6%, marking its worst performance in over two months.

The SOX index has declined by approximately 24% from its peak in June. This downward trend is further exacerbated by public opposition to the high energy consumption required by AI data centers.

President Trump has publicly opposed new AI regulations, citing concerns over competitive advantages. Meanwhile, polls indicate that voters across party lines support mandatory federal safety reviews for advanced AI systems.
