Senators Josh Hawley and Chris Murphy are preparing new legislation focused on AI liability. The initiative aims to establish legal accountability for AI developers regarding damages caused by their systems.

The proposed bill follows two existing legislative efforts introduced by Hawley. The AI LEAD Act, presented on September 29, 2025, seeks to classify AI systems as products under federal law, allowing victims to file liability claims against companies.

The second proposal, the GUARD Act, introduced on October 28, 2025, targets the protection of minors. It includes provisions to ban AI companions for children and mandates that chatbots disclose their non-human nature, with potential criminal penalties for violations.

As of early 2026, both the AI LEAD Act and the GUARD Act remain under legislative consideration. Congress has conducted hearings involving testimonies about AI-related harms, with discussions referencing major industry players such as OpenAI and Google.
