The Digital Asset Market Clarity Act remains stalled in the US Senate following a failed procedural vote on September 15, 2026. The legislation required 60 votes to advance, but failed to reach the threshold after Senator Angela Alsobrooks withdrew her support.
The bill previously passed the Senate Banking Committee with a 15-9 vote on May 14-15, 2026, with Senator Ruben Gallego as the only other Democrat to support it. Alsobrooks later demanded stricter ethics provisions regarding an estimated $1,4 billion in profits linked to the Trump family's digital asset activities.
Between July and September 2026, authors added a 2029 sunset clause to the bill. However, disagreements persist over whether the Department of Justice or state attorneys general should enforce ethics rules. Bipartisan negotiations are ongoing but remain deadlocked.
