The U.S. Senate failed to advance the Digital Asset Market Clarity Act on September 15. The procedural vote resulted in a 49-50 outcome, falling short of the 60 votes required to move the bill forward.
The proposed legislation aimed to clarify the classification of digital assets and define the regulatory jurisdictions of the SEC and the CFTC. The bill included 126 substantive changes requested by Democrats.
Republican Senators Susan Collins, Josh Hawley, Jerry Moran, and Thom Tillis voted against the measure. Senator Tillis stated his vote was intended to preserve the ability to seek reconsideration.
The failure to pass the act leaves the industry operating under agency guidance and state-level rules. Meanwhile, financial institutions continue to integrate blockchain technology and tokenization.
Market participants now face ongoing regulatory uncertainty regarding investment decisions and product economics. The legislative path remains narrow as the November midterms approach.
