Senate Republicans released a revised 635-page draft of the Digital Asset Market Clarity Act (H.R. 3633) on September 13. The new version incorporates 126 changes requested by Democrats to secure necessary votes for the upcoming cloture motion on September 15.
The updated bill removes explicit criminal protections for blockchain developers, miners, and validators. The original draft included a shield against prosecution under 18 U.S.C. § 1960, which governs unlicensed money transmission. The revised text retains only civil and regulatory safe harbors.
The compromise introduces a permanent ban on public officials holding financial interests in digital assets exceeding $15 000. Additionally, the bill expands enforcement authority to state attorneys general, allowing them to pursue actors in the digital asset space alongside federal agencies.
Republicans currently hold 53 seats in the Senate and require at least seven Democratic votes to reach the 60-vote threshold needed to advance the legislation. The bill was originally introduced as S. 3611 on January 12, 2026, by Senators Cynthia Lummis and Ron Wyden.
