A group of Claude subscribers filed an expanded class-action lawsuit against Anthropic, alleging deceptive advertising regarding its Max subscription tier. The plaintiffs claim the company misled users about usage limits, which are significantly more restrictive than marketing materials suggest.
The Max plan offers two tiers: $100 per month for 5x the usage of the Pro plan, or $200 per month for 20x. However, the lawsuit alleges these limits apply only to five-hour windows subject to additional weekly caps, resulting in lower total capacity than advertised.
Attorneys Monica Vaca and Kati Daffan, both former Federal Trade Commission employees, represent the plaintiffs. They argue that clarifying information is hidden behind multiple hyperlinks, making it difficult for consumers to understand the actual service terms before purchasing.
Anthropic introduced the Max plan in April 2025 and implemented the contested weekly limits in August 2025. In a previous motion to dismiss, the company argued that the terms were accessible to users through links provided during the purchase process.
The legal action highlights broader industry tensions as AI companies pass high operating costs to customers. Anthropic recently addressed customer feedback regarding pricing in its Fable 5.1 model release, though the company did not comment on the current lawsuit.
