Governor Abigail Spanberger signed Executive Order 22 on September 18, 2026, introducing new oversight for data center development in Virginia. The order prohibits executive branch officials from entering into non-disclosure agreements regarding data center projects to increase transparency.

The new framework mandates local public approval for any data center facility with a capacity exceeding 25 megawatts. Additionally, the order requires the implementation of expedited noise regulations and a comprehensive review of backup-generation operations at these sites.

The directive sets stricter clean energy standards for backup power and imposes limits on natural gas generation at data center locations. A newly established AI Task Force will evaluate risks related to workforce displacement, data privacy, and cybersecurity threats.

Virginia has implemented other financial measures in 2026, including a statewide electricity consumption tax on data centers projected to generate $600 million annually. A State Corporation Commission ruling also shifted transmission infrastructure costs from residential ratepayers to data center operators.
