The US House Ways and Means Committee approved the Digital Asset Tax Certainty Act on September 16 with a vote of 38 to 5. The bill now moves to the full House for consideration. It aims to clarify tax treatment for digital assets, including mining, staking, and broker requirements.

A key provision of the bill sets a $10 exemption threshold for small daily cryptocurrency transactions. This measure intends to simplify tax compliance for minor payments. The legislation also addresses income recognition, wash sales, and specific tax treatments for qualified USD stablecoins.

Committee Chairman Jason Smith noted the necessity of the threshold to avoid complex compliance for small purchases. While the bill received bipartisan support, Representative Lloyd Doggett criticized the committee for prioritizing the crypto industry over other legislative needs, citing the recent failure of the Digital Asset Market Structure Act.

The bill faces a tight timeline for further advancement. With the current congressional session nearing its end, proponents have a window of approximately five weeks between the November elections and the start of the new Congress in January to push for additional progress.
