The U.S. Senate is scheduled to vote on a cloture motion for the Clarity Act, H.R. 3633, at 2:15 p.m. ET on Tuesday. The bill requires 60 votes to end debate and proceed to a final floor vote. Republicans hold 53 seats, meaning they need approximately seven Democratic votes to advance the legislation.
Senator Cynthia Lummis stated that the revised bill incorporates over 120 demands from Democrats. These include a new ethics framework that restricts the president, vice president, members of Congress, and federal judges from issuing or sponsoring digital assets. Enforcement would fall to state attorneys general.
The House of Representatives passed its version of the bill in July 2025 with a 294-134 vote. The Senate Banking Committee approved the measure in May 2026 by a 15-9 vote. The legislation aims to divide digital asset oversight between the SEC and the CFTC.
Prediction markets show uncertainty regarding the bill's passage. Polymarket odds for the Clarity Act becoming law in 2026 dropped to 19% on Tuesday, down from 35% the previous day. Traders estimate a 55% chance that over 50 senators will vote yes, but only a 32% chance of reaching the 60-vote threshold.
Market reaction has been negative, with Bitcoin falling below $77,000 to $76,212. Ether dropped 4.64% to $2,414.55, and XRP declined 2.61% to $1.38. The total cryptocurrency market capitalization decreased by 2.99% to $2.6 trillion, with $636.89 million in liquidations recorded over 24 hours.
