Rosreestr has decided against creating a separate land use category for data centers, rejecting proposals from industry participants. The agency stated that introducing a new category would require extensive changes to urban planning documentation and EGRP records, potentially delaying projects and creating security risks.
Data centers can continue to be placed on land plots with various existing usage types, such as offices, warehouses, or industrial facilities. The classifier for permitted land use has been updated to include the placement of data processing and storage equipment within buildings and structures.
Industry representatives previously sought a specific land category to address uncertainties regarding land payments and rising costs. For instance, in the Moscow region, the coefficient for calculating rent on land plots designated for communications increased from 1.1 to 75 starting January 1, 2026.
Currently, data center operators use various codes including 'Communications', 'Administrative Management', and 'Scientific and Production Activity'. This leads to inconsistent requirements and payment volumes, sometimes resulting in penalties when municipalities reclassify the use of a facility.
