Polymarket is currently in talks with regulators in the European Union and the United Kingdom to reclassify its platform. The company aims to be recognized as a financial services provider rather than a gambling site, which would allow it to operate under the MiFID framework.
The platform has initiated discussions with the European Commission, the European Securities and Markets Authority (ESMA), and the UK Financial Conduct Authority (FCA). Currently, the company faces significant operational hurdles as gambling regulations vary across EU member states, leading to access bans in France and Spain.
The UK regulator, the FCA, maintains that it only oversees markets involving financial or specific climate events. Political and sports-related betting remains under the jurisdiction of the UK Gambling Commission, requiring separate licensing.
Regulatory authorities remain skeptical of the platform's business model. ESMA recently issued a warning regarding insider trading risks on prediction markets. Reports indicate that individuals, including a Google employee and a White House staffer, have used non-public information for trades.
