The US Securities and Exchange Commission is concluding the public comment period for its proposed 'Regulation Crypto Assets' this Tuesday. The agency introduced these rules in August to establish a framework for investment contracts involving digital assets.
Over the 60-day period, the SEC received approximately 140 comments from various interest groups and individuals. The feedback focused on proposed safe harbor provisions for token issuers and potential exemptions for companies conducting offerings up to a specific threshold.
The MiCA Crypto Alliance expressed support for the proposed disclosure requirements, suggesting that the SEC should further refine definitions for crypto-specific data structures. Meanwhile, Anthony Scaramucci of SkyBridge Capital also voiced his support, noting that the regulations align with the agency's role.
Despite the feedback, some legal experts argue that these rules may be more vulnerable to being overturned compared to legislation passed by Congress. Additionally, both the SEC and the Commodity Futures Trading Commission currently face leadership staffing shortages.
