The House Ways and Means Committee approved the Digital Asset Tax Certainty Act (H.R. 10357) on September 16, 2026, with a 38-5 vote. The bill, introduced by Rep. Jason Smith, aims to clarify tax rules for digital assets and includes a $10 de minimis exemption for transaction fees.
Rep. Don Beyer opposed the bill and proposed amendments to ban government officials from holding digital assets while in office, requiring them to divest existing holdings. These amendments were rejected, and the committee advanced the legislation in its original form.
Beyer criticized President Trump, alleging personal financial gain from crypto ventures. Research estimates that Trump and his affiliates generated between $800 million and $2.3 billion from such activities since he returned to office.
The committee vote occurred one day after the Senate Clarity Act failed to advance in the Senate, losing a procedural vote by a margin of 49 to 50.
