The European Securities and Markets Authority (ESMA) has issued a warning regarding the increasing integration of crypto-asset markets with the traditional financial system. In a recent risk monitoring report, the regulator highlighted that these growing ties could facilitate the spread of financial shocks across broader markets.

ESMA specifically identified tokenized equities, decentralized finance (DeFi) exploits, and prediction markets as primary areas of concern. While tokenized equities currently represent a small portion of global stock markets, the regulator noted that their rising adoption could introduce new infrastructure and participants, potentially altering existing market structures.

The regulator also expressed concerns regarding prediction markets, citing risks related to market manipulation, wash trading, and insider trading. ESMA stated that the use of crypto assets in these markets complicates the detection of illicit activities, making oversight more challenging for authorities.

In the United States, prediction markets are currently subject to a legal dispute over regulatory jurisdiction. The Commodity Futures Trading Commission (CFTC) asserts authority over federally regulated event contracts, while several states seek to apply local gambling laws to these operators.

The conflict involves multiple states, including Kentucky, Minnesota, New Mexico, New York, Illinois, and Connecticut. On September 2, New Jersey officials petitioned the US Supreme Court to clarify whether state gambling laws can be enforced against CFTC-registered prediction markets.
