The Chinese Ministry of Commerce and the Ministry of Science and Technology have released draft export regulations for artificial intelligence, photovoltaics, and biomedicine. The proposal updates the national Catalogue of Technologies Prohibited and Restricted from Export by adding 40 new technologies.
Under the new rules, 14 technologies face a total export ban, while 26 require a government license. The restrictions specifically target AI systems trained with at least 10²⁶ FLOPs of compute or those containing 2 trillion parameters.
The draft prohibits the transfer of model weights, training data, and technical expertise to foreign entities. While international companies can still access Chinese AI via cloud platforms and applications, deploying these systems overseas or acquiring ownership will require government approval.
The proposal includes 23 AI-related technologies, 12 in photovoltaics, and 5 in biomedicine. Projects aligned with open-source initiatives may be eligible for automatic licensing. Public comments on the draft are accepted until November 15, 2026, with final rules expected by the end of the year.
