California Governor Gavin Newsom has signed Assembly Bill 2409, which restricts public officials from issuing meme coins. The legislation, authored by Assemblymember Avelino Valencia, aims to prevent conflicts of interest and financial crimes involving speculative digital assets. It defines meme coins as assets whose value is primarily driven by internet trends, memes, or public speculation.
Starting January 1, 2027, digital asset service providers will be prohibited from listing meme coins issued by or in partnership with federal, state, or local public officials. The law grants authority to the state attorney general, district attorneys, and city attorneys to pursue civil enforcement actions, including injunctions and asset disgorgement against violators.
In addition to AB 2409, Governor Newsom signed Senate Bill 1208, which updates state money-laundering laws to include digital assets. This measure allows law enforcement to seize crypto wallets and accounts linked to criminal activity and establishes protocols for asset freezing and victim compensation. These provisions are set to remain in effect until January 1, 2032.
The new regulations reflect a broader trend of states developing independent oversight for digital assets while federal legislative efforts remain ongoing. Similar restrictions on politicians promoting or issuing digital assets have been proposed at the federal level, including the Clarity Act, though such measures have yet to pass the U.S. Senate.
