The US International Trade Commission (ITC) launched an investigation on September 16 into potential patent infringements involving audio technologies. The probe targets Samsung Electronics, its US subsidiary, Apple, and Google.
The investigation follows a complaint filed by BoomCloud 360 Inc. on August 14, 2026, with additional information submitted on August 31. The company alleges that imported electronic devices from these tech giants violate Section 337 of the Tariff Act of 1930.
BoomCloud 360 Inc. is seeking a limited exclusion order and a cease-and-desist order from the ITC. The commission clarified that the initiation of this investigation does not constitute a formal finding of patent infringement.
The case has been assigned to an administrative law judge who will conduct evidentiary hearings to reach a preliminary ruling. This ruling will then undergo a formal review by the ITC to determine the final outcome.
The ITC will set a target date for completing the investigation within 45 days of the case initiation. Any remedial orders issued under Section 337 become effective immediately and final after 60 days, unless overturned by the US Trade Representative.
