Hester Peirce, a commissioner at the Securities and Exchange Commission, resigned on October 2, 2026, after serving for eight years. She joined the agency on January 11, 2018. Following her departure, the commission is left with only two active members, which may impact the speed and political balance of future rulemakings.
During her tenure, Peirce advocated for clear regulatory frameworks rather than regulation through enforcement actions. In 2025, she was appointed to lead the SEC’s Crypto Task Force, which focused on defining rules for digital asset custody, security classifications, and disclosure obligations for token issuers.
Prior to her exit, the SEC released proposals regarding crypto asset custody, marking a shift toward formal rulemaking. Chairman Paul S. Atkins and Commissioner Mark T. Uyeda publicly acknowledged her contributions to digital asset advocacy on October 1, 2026.
Peirce is set to transition to academia in November 2026, where she will join the Regent University School of Law as an associate professor. The future of the remaining regulatory framework for digital assets now depends on the appointments to the commission's vacant seats.
