Michael Saylor, executive chairman of Strategy, stated on September 16 that US regulators are moving forward with digital asset rules using existing statutes. This approach bypasses the stalled CLARITY Act, as federal agencies like the SEC, CFTC, and Treasury Department utilize their current legal authority to establish industry guardrails.

The SEC issued guidance on December 17, 2025, regarding custody obligations for crypto asset securities for broker-dealers. Additionally, the Office of the Comptroller of the Currency has authorized nationally chartered banks to provide digital asset custody services. Saylor also noted the GENIUS Act as a potential driver for stablecoin adoption.

Strategy currently holds hundreds of thousands of BTC. Approximately 40% of these assets are managed by Coinbase Custody, with the remainder held by Anchorage Digital Bank. Both entities operate under US regulation. The company aims to leverage bank-offered custody and collateralized lending to access liquidity without selling its positions.

Institutional investors, including pension funds and insurance companies, often require regulated banking institutions for asset custody. As major banks expand their digital asset services throughout 2026, these institutional players may gain easier access to the market. Saylor views these regulatory shifts as a catalyst for broader institutional adoption.
