Michael Saylor, executive chairman of Strategy Inc., stated on September 16, 2026, that the Senate's failure to pass the CLARITY Act could boost institutional investment in Bitcoin. He believes existing regulators already have sufficient authority to oversee digital assets without new congressional mandates.
The CLARITY Act (H.R. 3633) failed a Senate cloture vote on September 15, 2026, with a 49-50 result, missing the required 60-vote threshold. The bill aimed to define jurisdictional boundaries between the SEC and CFTC regarding digital assets.
The House of Representatives previously passed the bill in July 2025, and the Senate Banking Committee advanced it in May 2026. However, disagreements over stablecoin provisions and ethics requirements stalled the legislation.
Strategy Inc. currently holds 845,050 BTC. The company acquired these assets for approximately $63.73 billion, with an average purchase price of roughly $75,412 per coin as of mid-September 2026.
Saylor noted that the GENIUS Act, which targets stablecoin regulation, continues to progress independently. He expects banks to increase their involvement in Bitcoin custody and collateralized lending services.
