The Moscow Arbitration Court has ordered RKService LLC to pay over 865 ₽ million in unearned advances, penalties, and fines for failing to complete the construction of an automotive electronics design center. The project, located on the territory of the Federal State Unitary Enterprise NAMI, was intended to modernize the institute's research and production base.
The Ministry of Industry and Trade unilaterally terminated two contracts signed in autumn 2022 totaling 1.46 ₽ billion. The first contract, valued at 1.25 ₽ billion, covered construction and installation work for the design center, while the second, valued at 206.5 ₽ million, focused on infrastructure, roads, and a dynamic platform.
Construction was scheduled for completion by December 2023. However, by November 2024, the contractor had failed to complete several stages. Delays reached 442 days for the fourth stage of the first contract and 497 days for the first stage of the second contract. The contracts were officially terminated on November 19, 2024.
The Ministry of Industry and Trade paid an advance of 800.4 ₽ million under the first contract. The court recovered 540.6 ₽ million of the unearned advance, 239.2 ₽ million in penalties, and 20 ₽ million in fines. For the second contract, the court ordered the recovery of 30.4 ₽ million in unjust enrichment and 34.7 ₽ million in penalties and fines.
General Director of RKService, Oleg Aksenov, claimed that the company faced opposition from NAMI and funding cuts. NAMI denied these claims, stating that advances were paid in full and on time. According to the government procurement portal, the Ministry of Industry and Trade has not signed any new construction contracts for the project.
