Oracle is seeking contractual payment protection for its Project Jupiter data center in New Mexico to mitigate financial risks if the facility misses its 2028 opening deadline. The project, which spans 1,400 acres, is currently 26% complete and faces a delay of at least seven months.
The development, managed by Stack Infrastructure and BorderPlex Digital Assets, is intended to support OpenAI's computing needs. Construction began in September 2025. The site plan includes four buildings and a microgrid designed to provide 2.45 gigawatts of power using Bloom Energy fuel cells.
Financial pressure is mounting as the project's $18 billion loan package trades at 89 to 91 cents on the dollar. Oracle's credit rating was downgraded to BBB- in September 2026, placing it one notch above junk status. The company is currently managing debt and construction risks.
Operational hurdles include denied natural gas pipeline permits, with related services delayed until at least February 2027. Legal challenges regarding environmental impact were partially addressed on September 17, 2026, when the New Mexico Supreme Court lifted key permitting stays.
