The CLARITY Act, formally known as H.R. 3633, is a 616-page bill designed to define the regulatory jurisdictions of the SEC and CFTC over digital assets. It introduces liability shields for open-source code developers and requires qualified custodians to segregate customer assets from company funds.
The legislation includes protections for stablecoins and measures to combat illicit finance, incorporating consumer safeguards and anti-money laundering rules. The merged Senate text was released on July 22, 2026.
The bill passed the House on July 28, 2025, with a 294-134 vote and cleared the Senate Banking Committee on May 14, 2026, with a 15-9 vote. A critical cloture vote is scheduled for September 15, 2026, at 2:15 PM ET, requiring 60 senators' approval.
Over 1,200 tech companies, including Amazon, Apple, and Google, along with national security experts, support the act. Senator Cynthia Lummis warns that failure to pass the bill on September 15 could delay comprehensive digital asset legislation in the US until after 2030.
