On September 17, US Federal Judge Mark Pittman ordered Elon Musk's companies, X and xAI, to disclose details regarding the withdrawal of their antitrust lawsuit against Apple. The companies voluntarily dropped claims against Apple earlier this week, stating they would not refile them, while maintaining the lawsuit against OpenAI.
The original complaint alleged that Apple and OpenAI colluded to limit the visibility of competing AI applications on the App Store by integrating ChatGPT into Siri and Apple Intelligence. Both Apple and OpenAI previously denied these allegations. The plaintiffs noted they had resolved the claims against Apple without providing further context.
Judge Pittman issued the order following an emergency motion filed by OpenAI, which requested the court to compel the disclosure of any settlement agreements between X, xAI, and Apple. The judge mandated that Musk's companies provide all documentation related to the resolution of the dispute with Apple to the court.
The court also required X and xAI to submit a formal response to OpenAI's motion by noon on September 17. The legal proceedings continue as the court seeks clarity on the nature of the agreement that led to the sudden dismissal of the charges against the iPhone manufacturer.
