The Commodity Futures Trading Commission has initiated a public comment period regarding proposed regulations for crypto trading platforms. Chairman Michael Selig stated that these measures aim to prevent fraudulent activities similar to the collapse of FTX, which involved the misappropriation of approximately $8 billion in customer assets. The agency is currently seeking feedback before drafting formal requirements.
The proposed framework introduces a specific exchange category termed a crypto asset market. Under these rules, registered exchanges would be permitted to offer retail traders access to leverage and margin products. In exchange for this authorization, platforms must adhere to strict mandates, including the segregation of customer funds, the implementation of market manipulation monitoring, and the mitigation of conflicts of interest.
Participation in this regulatory regime remains voluntary, as the agency currently lacks the legislative authority to mandate such compliance without congressional action. The proposed rules follow the launch of leveraged retail spot crypto trading by Bitnomial in December 2025. Bitnomial currently holds three relevant licenses from the commission to conduct these operations.
The industry landscape continues to shift as Kraken parent company Payward reached an agreement in April to acquire Bitnomial for a sum of up to $550 million. The public comment period for the new proposal will remain open for 60 days following its publication in the Federal Register. A formal proposal and a final vote are required before any new regulations become legally binding.
